Hmm, but who is bound to spot him there? the 5th hokage? Highly doubt team 07 since they have no idea whats happening with Team hebi. unless this happens:
Sasuke ditches Team Hebi.
Team 07 found Team Hebi right after Sasuke left.
They talk/fight and Team 07 found that Sasuke already left back to the Uchiha Hideout. which they might think is in konoha. So team 07 goes back to konoha and found out the hokage saw Sasuke around a weird place. Etc etc etc...
