From the moment we saw Vergo, he had it with him. So it's also logical to say it was on him through out the skirmish. The real fight going on is for whatever is in the SAD room. It just so happened dat one party has a huge advantage in the fight by being in possession of other's heart.

yes, looks like you are right, he's using Law's heart against him since the very beginning. After rereading it i realised that the inexplicable pain law experienced here must be vergo squeezing it.
